Title Issues on a Mesa Manufactured Home: County Recorder or MVD?

| By Tricia Manara

Ninth question in my manufactured-homes series, and the one where deals quietly go sideways: who actually owns the Mesa manufactured home you are about to buy? The answer lives in the title, and the title lives in one of two very different places. Either it is recorded at the county as real property, like a house, or it is titled through the Arizona Motor Vehicle Division like a vehicle. Which one you are looking at decides your closing, your taxes, and whether the sale happens at all.

The two title worlds

When a manufactured home is affixed to land you own and the owner files an Affidavit of Affixture with the county recorder, the home becomes real property. The old MVD title gets surrendered, the home is added to the property tax roll, and it sells with the land through a deed and title insurance, exactly like a site-built house. That is the version I market, and the version that finances, insures, and resells like the real estate it is. The legal side of that line is covered in my real property vs. personal property post.

When the home is not affixed, it stays personal property, and Arizona titles it through the MVD. Here is the part that catches people: a double-wide gets a separate title for every section, and transfers happen at MVD offices, not through escrow. Two very different closing processes for what looks like the same home on the same street.

The title problems I actually see

Missing section titles. If a double-wide only has one title and the other section was never titled or was lost, the sale halts until it is sorted out. Delinquent property taxes. The MVD posts unpaid taxes to the title record and will not transfer ownership or issue a duplicate title until they are paid current. Outstanding liens. A lien blocks the transfer until there is a payoff or release in writing. Lost titles. You cannot transfer what you cannot produce, and a duplicate takes time and requires current taxes.

What to check before you offer

Three things, every time. First, ask how the home is titled: at the county as real property or through the MVD as personal property. That one answer changes everything downstream, including whether the deal can even close through escrow. Second, verify the seller is the person named on the title and that the serial number on the home matches the paperwork, because a mismatch is a red flag worth running from. Third, for any home that came from out of state, check for a certificate of compliance from the Arizona Department of Housing's Office of Manufactured Housing, because Arizona requires it before a home can be titled or an Affidavit of Affixture recorded.

The series so far

This is the ninth deep dive in my manufactured-homes series. Start with the land question in land-owned vs. leased land in Mesa, then the 55+ vs. non-age-restricted communities detail, the affixed vs. non-affixed distinction, the 1976 HUD Code and financing, real property vs. personal property, HOA and community rules, park fees and space rent, and the resale value deep dive. The whole picture, including titles, insurance, inspections, and resale, is in our complete guide to land-owned manufactured homes in the East Valley.

Bottom line: title problems are fixable, but only if you catch them before you fall in love with the home. I have marketed a substantial owned-land manufactured home in Mesa, and clean title records were part of why that home sold the way it did. When you are looking at a manufactured home in Mesa, Gilbert, Chandler, or Apache Junction and you are not sure who actually owns it, that is exactly what I am here for. Message me or schedule a call, and I will run the title, the taxes, and the paperwork, and tell you straight whether the deal is clean. Zero drama, that is my job. Nice talking to you.
